The terms “we”, “us” and “our” refer to Waikanae Paper Artist. Waikanae Paper Artist operates this store and website, including related information, content, features, tools, products and services, in order to provide you with a curated shopping experience (the “Services”).

Waikanae Paper Artist is powered by Shopify, which enables us to provide the Services to you.

We reserve the right to discontinue a product or limit availability where reasonably necessary.

Products purchased directly through Waikanae Paper Artist are prepared and fulfilled by Waikanae Paper Artist unless otherwise stated on the product page.

Products displaying a Shop on Zazzle button are printed and fulfilled separately by Zazzle.

Nothing in this section limits your rights where a product fails to comply with applicable consumer guarantees.

SECTION 3 – HOW PRODUCTS ARE PURCHASED

Waikanae Paper Artist offers products using more than one purchasing and fulfilment method.

The purchasing method applicable to a product will be stated on the product page.

Products purchased directly through Waikanae Paper Artist

Products available through the checkout on this website are purchased directly from Waikanae Paper Artist using Shopify-powered checkout.

When you submit an order, you are making an offer to purchase.

An order is not confirmed until it has been accepted and payment has been successfully processed.

We may decline or cancel an order where reasonably necessary, including because of pricing errors, stock or production availability, suspected fraud or inability to fulfil the order.

If we cancel an order after payment has been taken, the relevant payment will be refunded.

Please review your order carefully before submitting it, particularly where the product is personalised, customised or made to order.

Direct purchases are subject to our Return & Refund Policy and Shipping & Fulfilment Policy.

Products purchased through Zazzle

Products displaying a Shop on Zazzle button are not purchased through Waikanae Paper Artist’s Shopify checkout.

Selecting the button allows you to choose your preferred Zazzle region before being taken to the corresponding Zazzle product page, where you complete your transaction directly through Zazzle.

For those products, Zazzle handles matters including payment processing, production, printing, packaging, shipping and applicable returns or refunds.

Your purchase through Zazzle is also subject to Zazzle’s current terms, policies, pricing and fulfilment conditions.

Questions or claims relating to an existing Zazzle order should normally be directed to Zazzle using the information associated with that order.

SECTION 4 – PRICES AND BILLING

Prices, discounts and promotions may change from time to time.

For products purchased directly through Waikanae Paper Artist, the applicable price will be shown on our website and confirmed during checkout.

Unless otherwise stated, prices may not include shipping, customs charges, duties or other charges that may apply to your order.

You agree to provide accurate and current billing, payment and account information when purchasing directly through our website.

Zazzle pricing

Any prices displayed or referenced on Waikanae Paper Artist for products ultimately purchased through Zazzle are for information only and may differ from the current price available on Zazzle.

Zazzle controls its own prices, currencies, discounts, promotional offers, taxes, shipping charges and product options.

The final price for a Zazzle product is the price displayed by Zazzle when you complete your purchase.

SECTION 5 – SHIPPING AND DELIVERY

Shipping arrangements depend on the purchasing method applicable to the product.

Products purchased directly through Waikanae Paper Artist using Shopify checkout are prepared, packaged and dispatched by Waikanae Paper Artist in New Zealand.

Direct shipping is currently available to New Zealand and Australia only.

Shipping charges and available delivery options will be shown at checkout.

Delivery times are estimates and may be affected by courier or postal delays, public holidays, weather events, customs processing or other circumstances outside our reasonable control.

Products displaying a Shop on Zazzle button are purchased, produced and shipped through Zazzle.

Zazzle determines its own shipping services, delivery estimates and charges according to the customer’s region, selected product and delivery options.

Direct purchases are also subject to our published Shipping & Fulfilment Policy.

Nothing in this section limits any delivery rights or remedies available under applicable consumer law.

SECTION 6 – INTELLECTUAL PROPERTY

Unless otherwise stated, the artwork, original designs, text, branding, photographs and other creative materials displayed through Waikanae Paper Artist are owned by Waikanae Paper Artist, Nicky Bourke, or are used with appropriate permission or licence.

These materials may be protected by copyright, trademark and other intellectual property laws.

The Services are provided for your personal, non-commercial use.

You must not reproduce, copy, distribute, modify, commercially exploit, republish or create derivative works from our original artwork, designs, photographs or written content without prior permission, except where permitted by law.

The name Waikanae Paper Artist, associated branding and original artwork by Nicky Bourke may not be used in a manner that falsely suggests endorsement, authorship or affiliation.

Shopify’s name, trademarks and branding remain the property of Shopify or its licensors.

Zazzle’s name, trademarks and branding remain the property of Zazzle or its licensors.

All other trademarks belong to their respective owners.

SECTION 7 – OPTIONAL TOOLS AND THIRD-PARTY SERVICES

We may provide access to tools, services or functionality offered by third parties.

We may not control these third-party services and do not guarantee their continued availability.

Your use of a third-party service may be subject to that provider’s own terms, conditions and privacy practices.

This includes links to Zazzle and may include links to social media platforms, payment providers, fulfilment partners or other services.

Complaints, questions or claims about transactions conducted directly with a third-party platform should generally be directed to that platform.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Waikanae Paper Artist is powered by Shopify, which enables us to provide the Services to you.

Purchases completed through the Waikanae Paper Artist Shopify-powered checkout are made directly with Waikanae Paper Artist.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and Waikanae Paper Artist, including any injury, damage or loss resulting from products purchased directly through Waikanae Paper Artist, except where liability cannot lawfully be excluded.

To the extent permitted by applicable law, Shopify and its affiliates are not responsible for claims, damages or liabilities arising from or related to purchases and transactions made directly with Waikanae Paper Artist.

For clarity: this section applies to purchases completed directly through the Waikanae Paper Artist Shopify-powered checkout.

Products displaying a Shop on Zazzle button are purchased separately through Zazzle and do not constitute a direct checkout transaction with Waikanae Paper Artist through this Store.

SECTION 10 – PRIVACY

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Because the Services are hosted by Shopify, Shopify may also collect and process personal information relating to your access to and use of the Services.

Certain information may be transmitted to Shopify or other service providers in order to provide the Services.

If you follow a Shop on Zazzle link and complete a transaction through Zazzle, information provided directly to Zazzle is handled according to Zazzle’s own privacy policy and practices.

SECTION 11 – FEEDBACK
